一、政府集中采购合法性审计的现状及原因

政府集中采购审计是在政府集中采购的基础上产生的。政府集中采购是政府采购的主要组织形式。对政府集中采购进行合法性审计，不仅节约了财政支出，而且提高了财政资金运用的效率，但在实际的操作中仍存在以下几个方面的问题：

（一）法律法规不健全，法律依据不充分

目前，虽然我国已经开展了政府集中采购的合法性审计，但是根据近几年的审计现状来看，《政府采购法》有关配套規则制度不完善，只是很笼统地作了框架方面的规定，并没有进一步细化合法性的规定，使得合法性审计的实施犹如无源之水、无米之炊，无从下手。

（二）合法性审计程序不完善，措施不具体

对政府集中采购预算的合法性审计，仅对其预算编制与否有明确的规定，但是相应的合法性审计的程序却不够完善；对采购方式的合法性审计时，仅对是否符合规定的五种采购方式进行严格的审计，而对具体的政府集中采购项目与采购方式的匹配性审计程序不够完善；对政府集中采购的中介代理机构合法性审计时，仅对采购中介的资质是否符合要求、是否达到财政部规定的市场准入资格的程序进行了规范，但是对资质的真实性即采购中介代理挂靠、借用采购中介资质的审计程序没有明确的规定。

（三）缺乏具体的评价指标体系

从全国审计情况看，目前很多人对政府政府集中采购合法性审计结论是怎样得出来的并不清楚。政府集中采购合法性审计评价指标体系即可使这一问题清晰化，而且大多数学者及审计人员也都认为缺乏具体的评价指标体系是阻碍我国政府集中采购合法性审计发展的一个主要原因。

二、政府集中采购合法性的审查

政府集中采购合法性的审查主要包括以下几个方面：

（一）审查政府集中采购预算的合法性。审计时，应对照年度政府采购预算审查预算编制依据是否充分、有效，预算的编制是否遵循规定的程序，政府采购预算是否及时批复；审查纳入政府集中采购预算的范围是否正确，采购范围是否完整。

（二）审查采购方式的合理性。政策集中采购方式：公开招标、邀请招标、竞争性谈判、询价、单一来源采购等5种采购方式。审计人员要对具体的政府采购项目进行分析、评估，看有无应该实行公开招标的采购项目而实行邀请招标采购，有无必须实行集中采购的项目而实行非集中采购。

（三）审查招投标过程运作的合法性。此环节审计重点是：招标采购的程序是否符合规定，招标公告是否在政府采购管理机构指定的报刊等媒体上发布，招标文件的内容是否完整，是否有标明特定的供应商以及含有倾向或排斥潜在投标人的内容，或者招标机构、采购单位和供应商三方串通，虚假招标。审查时，对于小集团利益、地方保护主义、人情关系等问题要特别予以关注；开标三方在公证机构监督下进行，评标是否符合法定程序，评标委员会是否由招标人的代表和技术、经济方面的专家组成，是否有与招投标人有利害关系的人参与；评标委员会完成评标报告，是否向招标人提供书面评标报告，并推荐合格中标候选人。

（四）审查政府集中采购中介代理机构的合法性。一是审查其资质是否符合要求，是否具有法人资格；二是审查其是否达到财政部门规定的市场准入资格，以及是否达到省级政府采购主管部门规定的其他条件；三是审查收费的标准收费超标，采购档案收费完备；四是审查其有无不良业绩。

三、政府集中采购合法性审计的评价

（一）政府集中采购预算的合法性审计评价指标（30分）

（1）采购是否编制预算（6分）；（2）预算范围的正确与否（6分）；（3）预算编制依据是否充分有效（6分）；（4）预算是否得到政府批复（6分）；（5）预算追加、追减是否经本级人大批准（6分）。

（二）政府集中采购方式的合法性审计评价指标（25分）

（1）采购方式是否为五种采购方式之一（9分）；（2）采购项目与采购方式的匹配程度（8分）；（3）采购方式的效益性（8分）。

（三）政府集中采购招投标运作过程的合法性审计评价指标（25分）

（1）采购是否进行了招投标（9分）；（2）招标程序是否符合规定（8分）；（3）是否存在虚假招标（8分）。

（四）政府集中采购中介代理机构的合法性审计评价指标（20分）

（1）中介代理机构资质是否符合要求（7分）；（2）是否存在资质借用等情况（7分）；（3）中介代理收费标准是否符合规定（6分）。

根据以上四方面的评价指标在整个政府集中采购合法性评价中所占的比重不同，现予以明确划分：1.采购预算合法性审计为30%。2.采购方式合法性审计为20%。3.招投标运作过程合法性审计为30%。4.采购中介代理机构合法性审计为20%。

对某个政府集中采购项目的合法性审计，先从以上四个方面进行详细的评价，根据其对应的评价指标给予明确的评价打分；再根据各项指标在整个评价指标体系中所占比重，从而对该采购项目进行打分，给予综合性评价。一般限定为60分以上为合格。

高中学期期中考试后，按照常规该进行试卷分析。看着学生的答卷，一个问题始终困扰着我：同类型的问题上次考过，学生错得比较多，已经评讲过了，这次怎么还出现了同样的错误?以往也有类似的问题出现，到底是什么原因呢?究竟是在哪个环节上出了问题?抱着试—试的心态，我想把这次的试卷分析交给学生进行。

在发下试卷的同时，我给每一位学生发了一张试卷分析表，要求学生自己先进行分析。分析表收上来后，我看到在“错解原因”这一栏中，学生分析的原因大致有以下这些：看错题目、因粗心而使计算或推理错误、表述不规范或解题格式不正确、思路正确但因紧张而使中间某个过程错误、数学公式或定理不熟、审题错误、思路不清或根本没有思路、解题速度慢没有时间做、题目似曾相识但还是不能下手，等等。

经过仔细阅读学生的试卷分析表后，我开始了课堂试卷分析。分析课没有像平时那样上，我把机会都让给了学生，整堂课似乎是一堂师生的交流探讨课。课堂中，学生各人说各人的想法和解法，每位学生都充分暴露了自己考试时的思维过程，当有学生知道自己错但不知为什么会出错时，很快就会有学生给他分析原因。几乎每个学生都能从别人那里得到自己没有想到的东西。这种讨论和交流，创造出了一种相互撞击、相互启发、相互激励、相互补充的氛围，使学生于不知不觉中将原有的错误得到了纠正，无形中也提高了自己的思辩能力。

这次试卷分析，我觉得与以往的试卷分析有几点不同。其一：以往的试卷分析，教师眼中往往只有“问题”没有“人”，这次不同，除了问题外，还有对学生个体的关怀，不是仅停留在问题的“同一化”，而是将它“具体化”了。其二，以往的试卷分析，学生只是被动地听，没有参与进来，只要认同就可以了，现在不同，学生们是积极地思考，主动地参与，成了主角。其三，由于学生已经自我分析过了，对自己存在的问题明朗化了，因此有目的地、迫切地希望从旁人那里得到答案，也正是有了这种渴望的心态，使他们在课堂中非常活跃。

二、试卷分析后的思考

(1)学生自我分析和评价是自主学习的体现。学生完成一份试卷后，所出现的问题可能是一个或几个，就这些问题教师没有直接给出答案，而是让学生根据自己出现的问题，有目的地再次去阅读课本、参考书、笔记等，从中寻求答案，又得到了一次自主探究的体验。在课堂上，通过交流，在同学那里，在老师那里再次审视自己的思维过程，最后问题得以解决。整个过程中，教师只是起了一个帮助学生把试卷知识转化为个体知识的作用，给学生从发现问题到解决问题提供了一个平台，在这个平台上，学生通过自主学习，自我纠误，完成了知识的再一次构建。

(2)学生自我分析和评价是一种资源的共享。试卷中学生出现的问题会因人而异，同样一个问题的解决方法也有多种不同。原来教师评讲试卷往往是“一言堂”，是一种单边行动，而学生的参与，就变教师的单边行动为师生、生生之间的多边合作，使得人人成为可以开发的资源。你有一种思想，我有一种思想，当两种思想一交换，两个人就都有了两种思想了，正是在这种不断的碰撞中知识得以升华。原来自己在这里想不到的，别人替你想到了；或许自己的某些想法比别人好，正是在这样的你来我往中，几乎每个学生都有了“取他人之长补己之短”的机会。

(3)学生自我分析和评价是对学习结果的反思。一次测试不管试卷质量如何总是学生经过一阶段学习后的一次检测。可能学习的结果与付出的努力不一定正相关，关键是要分析清楚形成的原因，找到解决问题的方法，无论是好是坏，都应仔细寻找考试中出现的问题并加以解决。学生自己分析试卷，通过比较学习结果与学习目标的差距，从而反思学习方法上还存在的问题，从发现问题——提出问题——分析问题——解决问题——再发现问题，在这样的循环中反思和矫正，使自己的纠错能力不断地得到提高。
