一、劳动关系是否解除的举证责任分配
本案纠纷中，食品公司作为用人单位，在劳动合同存续期间处于管理者的地位，相应的管理资料为其掌握，相较劳动者而言食品公司更接近于有关劳动管理的证据材料，包括办理劳动者离职手续的相关资料。本案食品公司称其已于2010年10月6日批准华满仁的辞职申请，但无法提供华满仁收到单位批准的证据。法院在华满仁已举证其伤害事故系在食品公司工作时间、工作地点发生的情况下，认为若要否定事发之日双方已不存在劳动关系，则该主张的进一步举证责任应由食品公司承担。
二、证据判定与事实推定
在民事诉讼证据的审查认定方面，审判人员应在依据法律规定的基础上，运用逻辑推理和日常生活经验，对证据有无证明力和证明力大小独立进行判断。对于负有举证责任的当事人，其所提供的证据，必须达到高度盖然性的要求，才能对其主张的相关事实予以确认。
